Mr F. Arnold, sub-manager of the Pathe Cinema Machine Co., summoned Mr V. D. Casley, of the Star Cinematograph, for an infringement of a trademark, belonging to the plaintiff company. Mr D. V. Steavenson, of Messrs Deacon, Looker and Deacon, appeared for the prosecution, and Mr Reader Harris, of Messrs Wilkinson and Grist, defended. On Monday, a new cinematograph opened in Wyndham Street of which defendant was the proprietor and a film was exhibited entitled 'Veiled Beauty.' The film had been exhibited without exhibiting the title and at the end a portion of a Pathé film had been pasted on the body of the film bearing the Eagle trademark. Defendant gave evidence and said that he had asked his operator to separate the 'Veiled Beauty' film from that of the 'Shortsighted Sportsman' as he was going to give the 'Veiled Beauty' to a friend. Unfortunately his operator had separated the films at the wrong place but the defendant was entirely ignorant of this until a policeman came to search for it.
