Summary
Albany, November 21 – The constitutionality of the American law prohibiting the admissions of children under sixteen years of age to motion picture theatres, unless accompanied by parents or guardians was upheld today by the Court of Appeals. The decision was given in the case of Mr. Jacob Van Brink, proprietor of a moving picture theatre in New York city, who appealed from the lower court's conviction for permitting children under sixteen to enter his playhouse alone. Van Brink contended the law was class legislation, inasmuch as it permitted children unaccompanied to attend performances conducted for the benefit of religious and educational institutions. The Court of Appeals affirmed the judgment of the lower court.
